Sóng Gió tại LHQ: Obama Chính Thức Công Bố Uy Quyền Đế Quốc Mỹ sau khi Bị Tổng Thống Ba Tây Lên Án Xối Xả


Đại Hội Đồng LHQ năm nay có những sóng gió bất thường. Những năm trước "sóng gió" thường luôn khởi đầu từ những quốc gia đối nghịch hay là mục tiêu tấn công của Âu Mỹ như các quốc gia Trung Đông như Iran, Syria, Libya v.v hay Nam Mỹ như Venezuella. Cuba v.v

Nhưng lần này đã có những "biệt lệ".
Theo truyền thống "trật tự" của LHQ , gồm chính thức 193 quốc gia thành viên 193 Members of the United Nations,- Ba Tây (Brazil) luôn là quốc gia đầu tiên lên phát biểu sau Tổng Thư Ký LHQ mở lời khai mạc. Truyền thống đặc biệt này dành cho Ba Tây vì Ba tây là một trong những quốc gia  sáng lập LHQ, và là một trong 20 quốc gia đóng góp tích cực nhất vào cơ quan này. Ba Tây cũng là quốc gia đầu tiên phát biểu trong cuộc họp đầu tiên của LHQ vào năm 1947. Điều này là trở thành Truyền thống danh dự cho Ba Tây đến nay.

Năm nay tại cuộc họp Đại Hội Đồng LHQ thứ 68 diễn ra từ ngày 24-9 đến 1-10 năm 2013. Giữ theo truyền thống, tổng thống Brazil, bà Dilma Rousseff đã mở đầu cuộc thảo luận với 2 điều bất thường:



1- Bà Dilma Rousseff trở thành một NGUYÊN THỦ QUỐC GIA PHỤ NỮ đầu tiên khai hỏa cuộc hội thảo tại Đại Hội Đồng Liên Hiệp Quốc từ ngày thành lập năm 1947.
2- Bà Dilma Rousseff cũng phá bỏ "truyền thống giải quyết mâu thuẫn quốc gia trong phòng kín" thay vì công khai tại hội thảo, bằng một bài phát biểu không đi vào đề tài chính mà tập trung lên án nhà nước Mỹ xối xả về tội phạm rình mò tấn công và trộm cắp thông tin mạng -không chỉ từ các công sở hay cơ quan tư  nhân của các quốc gia khác, mà còn rình mò ăn cắp từng cá nhân  thường dân viên chức - và  vi phạm ngay tại cơ sở LHQ -đặc biệt là đối với nước Ba tây, xâm nhập văn phòng tổng thống của Bà. Điều đặc biệt táo bạo đầu tiên mà bà  Dilma Rousseff là xỉ vả nước Mỹ, một quốc gia có tổng thống là Obama đang chờ để phát biều kế cận ngay sau Ba Tây.

“ Một quốc gia chủ quyền sẽ không bao giờ có thể tự đặt mình thành mối tác hại cho những quốc gia chủ quyền khác.. Cái quyền an ninh của công dân một quốc gia không bao giờ có thể được bảo đảm bằng cách xâm phạm nền tảng nhân quyền và dân quyền của công dân các nước khác..Và tồi tệ hơn khi ngay cả các công ty tư nhân lại tham gia vào hành động rình mò lén lút này... Chúng tôi đã cho chính phủ Mỹ biết sự phản đối của chúng tôi, và đòi hỏi sự giải thích, lời xin lỗi và lời cam đoan rằng những lề lối như thế này sẽ không bao giờ tái diễn nữa ...(A sovereign nation can never establish itself to the detriment of another sovereign nation...The right to safety of citizens of one country can never be guaranteed by violating the fundamental human and civil rights of another country’s citizens....And it’s even worse when private sector companies participate in this type of spying activity...We have let the US government know our disapproval, and demanded explanations, apologies and guarantees that such procedures will never be repeated)

Ngay sau đó Obama lên phát biểu, trơ trẽn tảng lờ và tuyên bố dối trá về những chính sách chủ trương "nhân quyền, hòa bình, dân chủ tự do" của Mỹ  Top 45 Lies in Obama's Speech at the U.N. 
Nhưng ngay sau đó, Obama khẳng định "tính biệt lệ (exceptionalism) quyền lực đế quốc" của Mỹ với tuyên bố rằng sẽ dùng bạo lực quân sự để "mở rộng" bất cứ tài nguyên nơi nào có "quyền lợi" của Mỹ:
"Nước Mỹ sẵn sàng dùng tất cả những phần của quyền lực chúng tôi, gồm sức mạnh quân sự, để bảo đảm những quyền lợi cốt lõi này tại khu vực. Chúng tôi sẽ đối phó thẳng những đe dọa đến với đồng minh và bạn bè, như chúng tôi đã làm trong cuộc chiến vùng Vịnh. Chúng tôi sẽ bảo đảm sự tự do  luân chuyển năng lượng từ khu vực này đến thế giới. Mặc dù Mỹ đang tuần tự giảm mức lệ thuộc của chúng tôi vào dầu hỏa nhập khẩu, thế giới vẫn lệ thuộc vào nguồn cung cấp dầu hỏa từ khu vực này, và một sụ gián đoạn trầm trọng có thể gây bất ổn cho nền kinh tế toàn cầu" (The United States of America is prepared to use all elements of our power, including military force, to secure these core interests in the region.We will confront external aggression against our allies and partners, as we did in the Gulf War.We will ensure the free flow of energy from the region to the world. Although America is steadily reducing our own dependence on imported oil, the world still depends upon the region’s energy supply, and a severe disruption could destabilize the entire global economy.)

Nói cách khác, nước Mỹ luôn sẵn sàng dùng tất cả những thủ đoạn xén lấn nội bộ bất kỳ nơi nào nó cho rằng đó là "quyền lợi quốc gia" của nó, từ việc nghe lén trộm cắp, xúi dục nội loạn, tạo đảo chính thay đổi chính thể cho đến đơn phương dùng quân sự tấn công bất cứ nước dầu hỏa nào dám "tự ý ngưng bán ra" dầu hỏa của họ, hoặc đồng thuận với nhau giảm lượng xuất khẩu không theo điểu kiện của Mỹ. Mỹ đã từng và đang làm như vậy, đảo chính Iran 1953, ViẹtNam, Nam Duong, Philipines, Hàn Quốc, Nam Mỹ Vênzuella, Panama, El Sanvadore, Chile,, Trung Đông Sadam, Gadafi v.v NSA rình mò nghe lén toàn cầu và ngay trong nước Mỹ! Kể cả hy sinh thí mạng quần chúng Mỹ!

Obama đã đi xa hơn bất kỳ một tổng thống nào của Mỹ trong việc công khai khẳng định tính biệt lệ và đơn phương quân sự của Mỹ.

Nhưng "biệt lệ" này và tính đế quốc này cũng sẽ chẳng tồn tại lâu. Nó chỉ là ảo tưởng cuồng vọng điên rồ không điểm đứng. Khi bà Dilma Rousseff tổng thống Ba Tây đã dám vỗ thẳng mặt Mỹ trước LHQ, qua những thông tin tội phạm do chính công dân Mỹ phanh phui, thì "quyền lực đế quốc" này đã lung lay. Và nhất là quần chúng thế giới đã thấy rõ tính bạo ngược vô pháp vô đạo của guồng máy nhà nước Mỹ không chỉ đối xử với nhân dân thế giới và ngay với chính công dân của nó trong hơn 10 năm qua từ ngày 911.. Xã hội Mỹ đang khủng hoảng và lũng đoạn toàn diện vì con đưởng đế quốc này.như mọi người đang chứng kiến Sự thay đổi mô thức ngay từ nội tại của Mỹ chỉ là vấn đề thời gian! Quyền lợi Nhà Nước Mỹ hay Quyền Lợi Quần Chúng Mỹ là hai điều khác biệt và đối nghịch nhau. "Quyền lợi quốc gia" chỉ là một nhóm chữ dùng để che đậy sự tùy tiện của Nhà nước mà thôi, dù ở bất cứ cơ chế chính trị nào!

United Nationas Sep 24 - Throwing diplomatic protocol to the winds, Brazilian President Dilma Rousseff launched a blistering attack on the United States for illegally infiltrating its communications network, surreptitiously intercepting phone calls, and breaking into the Brazilian Mission to the United Nations.Departing from a longstanding tradition of closed-door diplomacy on bilateral disputes, she dropped a political bombshell on a room overflowing with world leaders, foreign ministers and ambassadors from 193 countries sitting in rapt silence.

Justifying her public criticism, she told delegates Tuesday that the problem of electronic surveillance goes beyond a bilateral relationship. "It affects the international community itself and demands a response from it."

Rousseff said recent revelations concerning the activities of a global network of electronic espionage have caused indignation and repudiation in public opinion around the world.

But in Brazil, she said, "The situation was even more serious, as it emerged that we were targeted by this intrusion."

She said that personal data of citizens was intercepted indiscriminately. Corporate information, often of high economic and even strategic value, was at the centre of espionage activity.

At the same time, Brazilian diplomatic missions, among them the Permanent Mission to the United Nations and the president's office, had their communications intercepted, she charged.

Rousseff unleashed her attack even as U.S. President Barack Obama was awaiting his turn to address the General Assembly on the opening day of the annual high-level debate, which concludes Oct. 4.

By longstanding tradition, Brazil is the first speaker, followed by the United States.

Even though Obama had the right of reply, he did not address the issues raised by Rousseff, who also cancelled a proposed official visit to the White House last week protesting the electronic surveillance of her country.

"We have let the U.S. government know our disapproval, and demanded explanations, apologies and guarantees that such procedures will never be repeated," she said.

According to documents released by U.S. whistleblower Edward Snowden, the illegal electronic surveillance of Brazil was conducted by the U.S. National Security Agency (NSA).

There has been considerable speculation that Brazil may initiate a General Assembly resolution condemning surveillance of member states by outside intelligence agencies. If it is brought before the Assembly, the United States and its Western allies may oppose it.

There have been reports that the NSA had also conducted similar surveillance of European countries and also the office of the European Union located in the U.N. neighbourhood.

Rousseff called on the United Nations to play a leading role in the effort to regulate the conduct of member states with regard to these technologies and the importance of the internet and social networks as a way to build democracy worldwide.

She said Brazil will present proposals for the establishment of a civilian multilateral framework for the governance and use of the Internet and to ensure the effective protection of data that travels through the web.

The Germany-based Der Spiegel magazine reported last month that NSA technicians have managed to decrypt the U.N.'s internal video teleconferencing (VTC) system, as part of its surveillance of the world body.

The combination of this new access to the U.N. and the cracked encryption code have led to "a dramatic improvement in VTC data quality and (the) ability to decrypt the VTC traffic," the NSA agents reportedly said.

In the article, titled "How America Spies on Europe and the U.N.", Spiegel said that in just under three weeks, the number of decrypted communications increased from 12 to 458.

Rousseff said she was publicly taking up the issue of surveillance because it was a matter of great importance and gravity.

Tampering in such a manner in the affairs of other countries is a breach of international law and is an affront to the principles that must guide the relations among them, especially among friendly nations, she added.

"A sovereign nation can never establish itself to the detriment of another sovereign nation," she said.

The right to safety of citizens of one country can never be guaranteed by violating the fundamental human and civil rights of another country's citizens, she added.

And it's even worse when private sector companies participate in this type of spying activity, she said.

Responding to the U.S. argument that any surveillance outside the United States was aimed only at monitoring terrorist activities, she said, "Brazil knows how to protect itself. We reject, fight and do not harbour terrorist groups."

Trong truần qua, ký giả Glenn Greenwald lại đưa ra một bằng chứng từ tài liệu Snowden chỉ rõ ràng Anh, Mỹ, Úc, Canada, và New Zealand không chỉ dùng hoại tín và ứng liệu đạo chích để tấn công trộm cắp bí mật các quốc gia "đối nghịch" mà ngay cả các quốc gia đồng minh cũng là nạn nhân: Công Ty Điện Toán Viễn Thông Belgacom của Bỉ, thủ đô Âu Châu, bị Anh Mỹ tấn công hoại tín và trộm cắm nặng nề. Thủ phạm trực tiếp là cơ quan Anh quốc GCHQ.
Trước đó, nạn nhân là Ba Tây khiến tổng thống Ba Tây dưới áp lực quần chúng đã phải đình chỉ những ký kết với Mỹ, và chính thức lên án Mỹ thẳng thừng với những biện pháp và ngôn ngữ mạnh mẽ cho đến hôm nay.
Dĩ nhiên, tất cả những cái gọi là "bí mật" này đều được những người hiều biết về bản chất chủ nghĩa quốc gia và nền  chính trị của nó nắm vững một cách mặc nhiên. Nhưng đối với đại đa số quần chúng thì nó là một gáo nước lạnh vào niềm tin "chính phủ nhà nước tận thiện" của họ.
Trước khi Edward Snowden bước lên đỉnh cao công luận để ném tung những bằng chứng nhãn tiền về một guồng máy tội phạm khủng bố khổng lồ trộm cắp rình mò của Âu Mỹ (gồm 5 vùng chủ đạo--Five Eyes- Mỹ-Anh-Úc, Gia Nã Đại- Tân Tây Lan) với sự hợp tác của nhiều chính phủ khác, trong đó đứng đầu là Đức, đã có cả một trận chiến hỏa mù, hay nói đúng hơn là một màn kịch rẻ tiền đã diễn ra trong mục tiêu  dùng Trung Quốc làm tấm bia giả để bẻ hướng dư luận việc rình mò trộm cắp thông tin qua mạng. Cũng cấn nhớ rằng Snowden không phải là người đầu tiên tố cáo tội phạm này của nhà nước Mỹ, trước đó Thomas Drake, William Benny hai nhân viên cao cấp của NSA đã tố cáo rộng rãi, nhưng không lấy được bằng chứng cụ thề và bị nhà nước Mỹ trù dập đối xử thô bạo. Snowden đã học từ những kinh nghiệm này, đã thu thập đầy đủ bằng chứng VÀ ĐI RA KHỎI TẦM TAY của bọn Nhà Nước Mỹ trước khi công khai TỐ CÁO những tội phạm này với CÔNG CHÚNG THẾ GIỚI.
Tất cả chúng ta đều nhớ quá rõ cách đây chỉ  hơn vài tháng- Hàng loạt bản tin từ các cơ quan "nghiên cứu" với những "chuyên gia" của guồng máy nhà nước Âu Mỹ -báo chí chính qui  rầm rộ tố cáo Trung Quốc đột nhập ăn cắp bí mật kỹ nghệ và quốc phòng của Mỹ và đồng minh. Các nhóm ngụy ngục và phỉ đần theo chủ nghĩa "tổ cò" cũng nối đuôi xỉa xói Trung Quốc. Tất cả nỗ lực thổi phồng con cọp giấy Trung Quốc lên đỉnh cao của "mối đe dọa thế giới".
Hãy nghe những trả lời sống sượng trơ trẽn của tướng Michael Hayden, cựu giám đốc NSA và CIA trả lời trong phim "tài liệu" We Steal Secrets" nhắm vào Wikileaks và Manning, khi được hỏi về sự khác biệt giữa việc trộm cắp của Mỹ và của Tầu:

Nhưng lý do chúng tôi trộm cắp những bí mật này là để giữ  cho công dân chúng ta được tự do, và an toàn. Chúng tôi không trộm cắp để cho công dân chúng ta làm giầu (bố khỉ). Nhưng đây lại  chính là điều người Tầu làm (Listen, I fully admit: we steal other country’s secrets. And frankly we’re quite good at it. But the reason we steal these secrets is to keep our citizens free, and to keep them safe. We don’t steal secrets to make our citizens rich. Yet this is exactly what the Chinese do)
Nhân Chủ xin ghi chú mạnh ở đây là tựa phim "tài liệu" CHÚNG TÔI TRỘM CẮP BÍ MẬT chủ đích nói về  Wikileaks, nhưng sự thật  đã vô tình đưa ra bằng chứng từ chính cửa miệng giám đốc NSA, CIA rằng không phải Wikileaks, mà chính Mỹ và đồng minh thân cận của nó TRỘM CẮP BÍ MẬTcủa người khác một cách rộng lớn nhất và hũu hiệu nhất. Trong khi Wikileaks KHÔNG BÁN TIN cho bất cứ ai, chỉ nhận ủng hộ từ những cá nhân có lòng yêu tự do và dân quyền. 
Chưa hết, khi nói về mối "đe dọa khủng khiếp" của  KẺ THÙ "cường quốc gian ác" Trung Cộng, chính Michael Hayden nhận định về "tiến trình Tầu trở thành Siêu Cường":
2-Gen. Hayden: "Tôi cũng muốn cho ông biết điều này. Tôi tin chắc chắn rằng TQ không phải là một hệ thống nhà nước lớn mạnh. Chắc chắn, đây là một quốc gia đang đạt phát triền đáng kể. Và đó là một điều tốt. Thật sự đúng như vậy. Tuy nhiên TQ còn rất nhiều những sai lầm yếu kém nội tại nền tảng cho dù là tại vấn đề nhân khẩu, sự bất bình đẳng xã hội, tính chính đáng của đảng CSTQ, hay là những vấn nạn môi sinh.

Tôi dự kiến rằng đây sẽ là một xã hội tự đối trọng nội chính trong thời gian rất dài sắp đến  vì những vấn nạn này. Tuy nhiên điều tôi lo ngại là đảng CSTQ mà tính chính đáng của nó không còn nằm trong ý thức hệ hơn 1  hay 3 thập niên qua, mà dựa vào 10 % tăng tưởng GDP mỗi năm, nỗi lo ngại của tôi là khi hướng tiến này chấm dứt, thì đảng CSTQ không còn khả năng tự động trở lại tính chính đáng của "Ưu Việt  Nho Giáo" nữa. Chúng ta tất cả đều biết qua các tay tạp bút mạng  người Tầu về những vấn nạn sâu đậm về tính đạo lý uu việt của đảng CSTQ đối vói quần chúng. Cho nên nỗi lo ngại của Tôi là đảng CSTQ  đang tìm tính chính đáng của nó ở biện pháp tự tồn cuối cùng: đó là CHỦ NGHĨA QUỐC GIA DÂN TỘC.

Nói như vậy, Tôi nghĩ rằng sắc xuất của việc xung đột giữa các nước lớn nhỏ hơn so với cả trong thời chiến tranh Lạnh. Sự hội nhập kinh tế và xã hội của người Tầu và các nền kinh tế  phương Tây cao hơn rất nhiều so với SoViet và Mỹ trong thời chiến tranh Lạnh. Điều đó báo hiệu rõ cho chúng ta một cơ hội  điều khiển sự cạnh tranh (TQ và Mỹ) này.
Và như Tôi có nói đâu đó trước đây TÔI KHÔNG CHO RẰNG TQ là KẺ THÙ của MỸ. Chẳng có lý do tốt đẹp nào để TQ là kẻ thù của Mỹ hết. Có đày dẫy những chọn lựa chính sách, hợp lý, không cần "anh hùng tính" cho giới lãnh đạo đôi bên thi hành để giữ mối bang giao ở mặt cạnh tranh, nếu như thi thoảng có đối nghịch căng thẳng, Tuy nhiên điều này chẳng bao giờ đi đến xung đột thật sự hết cả.

Having said that, I think the probability of major power conflict is less than it was during the Cold War. The economic and social integration of the Chinese and West’s economies is much higher than it was between the Soviets and the United States during the Cold War. That augurs well for us having a chance of controlling this competition.
And, as I have said elsewhere, I don’t think China is an enemy of the United States. There is no good reason for China to be an enemy. There are logical, non-heroic policy choices available to the leaders of both nations that will allow the relationship to remain competitive, if occasionally confrontational. But it never has to get to actual conflict.)
Những câu trả lời của tướng M.Hayden đã gây bàng hoàng cho "giới chính qui" và tín đồ của Nhà nước. Vì nó không chỉ rõ ràng là một lời thú tội thẳng thắn và thành thật nhất từ một viên chúc cao cấp từng giữ rất nhiều chức vụ quan trọng trong guồng máy của "Biệt Đội", khác với  một Robert McNamara ăn năn ân hận trong "Fog of War" Hayden sống sượng, trơ trẽn, và đầy tự hào dù - chưa đầy đủ,  nhưng cũng là  gáo nước lạnh tạt ngược vào tất cả những tuyên truyền về "mối đe dọa" của con con cọp giấy TQ từ các "cơ quan chuyên gia danh tiếng". Nó làm cho các nhóm "ái quốc thờ Mỹ" ngu ngơ nơi các xứ bán khai như Cuba, ChiLe, Úc Vietnam v.v hẫng chân!

Sau Edward Snowden, tất cả "sức mạnh" của vũ khí  "thuyết âm mưu" dùng để tấn công bịt miệng các tố cáo phanh phui tội ác nhà nước chính phủ đã gần như bị vô hiệu hóa; và với việc trả lời của M.Haydens nó giáng thêm một đòn tự thiến vào chính chủ nghĩa Nhà Nước (Statism), mẹ đẻ của chủ nghĩa Quốc Gia Dân Tộc: Nhân Danh Nhà Nước tận thiện bảo vệ công dân, Nhà nước toàn quyền ngồi trên pháp luật và được quyền tận dụng tất cả, sinh mạng, danh dự, nguyên lý v.v bằng những lý lẽ đơn giản và trần truồng ngược ngạo nhất.

Qua tài liệu Wikileaks, và  từ Snowden tung ra, cộng thêm với sự THÚ NHẬN của cụu bộ trưởng quốc phòng Mỹ  Robert McNamara  trong "Fog of War", cụu giám đốc NSA, CIA M.Hayden trong "We Steal Secrets", và các thú nhận của các nhà nước liên hệ như Đúc Pháp, Bỉ, Ba Tây v.v Chúng ta không chỉ khẳng định rõ ràng rằng khối Âu Mỹ đứng đấu với  bản doanh tại Mỹ -với guồng máy đồ sộ tài chính và  kỹ thuật tìunh báo tân tiến, chính là kẻ trộm cắp khủng bố lớn nhất và nguy hiểm nhất, Nó chính là mối đe dọa an ninh toàn cầu và nguồn khủng bố toàn cầu: TẠO DỰNG , NUÔI DƯỞNG và ủng hộ CÁC TỔ CHỨC KHỦNG BỐ TAY SAI khác như Al Qeda v.v ; mà chúng ta còn có thêm tính khẳng định của nhà kinh tế Áo quốc Ludwig Von Mises:

Dù ở Trung Quốc, VietNam, Mỹ Anh, Pháp, Miên, Ecuadore, Arap Soudi, Syria, Iran  v.v Người dân luôn bị Nhà nước ĐÒI  HỎI TUÂN PHỤC TUYỆT ĐỐI,  bị ĐE DỌA BẠO LỰC THƯỜNG TRỰC, và BỊ HY SINH khi cần vì  lý cớ AN NINH QUỐC GIA, TIỀN ĐỒ TỔ QUỐC... Không có biệt lệ TRỪ THỤY SĨ!

Cuối cùng , một chi tiết dù nhỏ, nhưng hàm ý rất lớn cần lưu ý, là tên sát nhân hàng loạt M. Hayden này xác nhận tính đe dọa hủy diệt của Chủ Nghĩa Quốc Gia Dân Tộc, nhưng vô tình hắn nhắc khéo cho chúng ta nhớ rằng chủ nghĩa quốc gia dân tộc chỉ là học trò của "chủ nghĩa quốc gia nhà nước" như Mỹ.  Tối Thượng Tập Quyền  khi không còn dựa vào được yếu tính "dân tộc" hay thần quyền thượng đế" nó sẽ mặc nhiên trở thành tập quyền tối thượng trên căn bản ảo thể Nhà Nước (The State) Tất cả cũng chỉ quy vào mục tiêu duy nhất là  QUYỀN TỐI THƯỢNG của CHÍNH PHỦ qua cái gọi là NHÀ NUỚC QUỐC GIA (Nation State)  một ảo thề phải được tin là TẬN THIỆN dù nó CỰC ÁC, vì lịch sử loài người đã minh chứng đầy dẫy máu xương của Nhà Nước dưới mọi hình thức là -Ác quán mãn doanh. Nghĩa là nó bao phủ lên tất cả một cách KHÔNG THỀ SỬA ĐỔI hay ĐIỀU CHỈNH được, trừ khi LOẠI BỎ HẲN NÓ.

Hình thành và điều hành một xã hội (Nation-Society) dĩ nhiên cần có những định chế dân sự để thực hiện những công việc và điều hòa sinh hoạt, nhưng không cần quyền lực tập trung tối thượng (The State) cho những định chế này. Thí dụ những hội từ thiện phi chính phủ đã và đang làm việc đắc lực trợ giúp xã hội con người một cách tự nguyện mà không cần nắm trong tay quyền lực chính trị để cưỡng ép bất cứ một ai ! Various items: NSA stories around the world

Revelations continue to produce outcomes on multiple levels in numerous countries around the world
(updated below - Update II [Tues.])
I'm still working at trying to get the next set of NSA stories published. That, combined with a rapidly approaching book deadline, will make non-NSA-article postings difficult for the next couple of weeks. Until then, here are a few items to note regarding a point I have often tried to make: namely, one of the most overlooked aspects of the NSA reporting in the US has been just how global of a story this has become:
(1) Last week it was revealed that Belgium's largest telecom, Belgacom, was the victim of a massive hacking attack which systematically compromised its system for as long as two years. Media outlets suspected that the NSA was behind it, and the country's Prime Minister condemned the attack as a "violation of a public company's integrity."
But last week, using documents obtained from NSA whistleblower Edward Snowden, Laura Poitras and other der Spiegel journalists reported in that paper that it was the GCHQ, Britain's intelligence agency, that was behind the attack on its ally. According to that report, the attack was carried out by targeting individual engineers at the telecom with malware that allowed GCHQ agents to "own" their computer and thus exploit their access to the telecommunications system.
It's worth remembering that as the US and UK run around the world protesting the hacking activities of others and warning of the dangers of cyber-attacks, that duo is one of the most aggressive and malicious, if not the most aggressive and malicious, perpetrators of those attacks of anyone on the planet. As Slate's Ryan Gallagher put it in a typically excellent analysis of this report:
"The disclosures are yet another illustration of the extremely aggressive scope of the clandestine spy operations that have been conducted by both the United Kingdom and the United States. Infiltration of computer networks is usually more commonly associated with Russian and Chinese government hackers, but the British and Americans are at it, too, even targeting their own allies' communications. The surveillance tactics appear to have few limits, and while government officials have played up the necessity of the spying for counter-terrorism, it is evident that the snooping is often highly political in nature."
Nobody hacks as prolifically and aggressively as the two countries who most vocally warn of the dangers of hacking.
(2) Along with reporter Shobhan Saxena, I have an article this morning in the Indian daily The Hindu revealing that "in the overall list of countries spied on by NSA programs, India stands at fifth place, with billions of pieces of information plucked from its telephone and internet networks just in 30 days."
(3) The report on which I worked for the Brazilian television program Fantastico, regarding the NSA's targeting of the oil company Petrobras, received attention in Latin America and elsewhere primarily because it gave the lie to the repeated claim of US officials that its electronic surveillance is devoted only to national security and counter-terrorism and not to industrial and commercial espionage. But several of the documents we published detail some rather extreme NSA and GCHQ tactics of deception, including taking on the identity of Google to launch "man in the middle attacks" on unsuspecting internet users.
(4) The New York Times had a quite good editorial yesterday on the domestic dangers posed by the NSA's efforts to break internet encryption. The Editorial details numerous ways that we have learned that the NSA jeopardizes the privacy rights of Americans and the security of the internet, and calls for serious limits on the NSA's hacking powers. Are there really people who can read that and think to themselves: I sure do wish Edward Snowden had let us remain ignorant about all of this?
(5) There has long been a glaring contradiction at the heart of the case for the NSA made by its apologists (the most devoted of whom, as of January 20, 2009, are Democrats). They insist that the NSA's spying activities are legal and constitutional (even though a 2011 FISA court opinion - released only in the wake of the last three months of scandal - found the opposite). But the real contradiction is that there have been almost no rulings on the legality or constitutionality of these spying laws and the activities conducted under them because the Obama DOJ - exactly like the Bush DOJ before it - repeatedly raised claims of standing and secrecy to prevent any such adjudication (the Obama DOJ relied on the five right-wing Supreme Court justices to win that argument earlier this year and prevent any constitutional or legal challenge to their domestic surveillance program).
Yet now, as the Hill reports, those arguments used by the DOJ to prevent judicial rulings are being gutted by all of the revelations in the wake of Snowden-enabled reporting. The Hill article quotes the ACLU's Alex Abdo as follows:
"For years, the government has shielded its surveillance practices from judicial review through excessive secrecy. And now that that secrecy has been lifted to some degree, we now know precisely who is being surveilled in some of the dragnet policies of the NSA, and those people can now challenge those policies. . . . . No matter what you think of the lawfulness of these programs, I think everyone should think their legitimacy or illegitimacy is better debated in public and decided by a court."
Does anyone disagree with that? Is there anyone who thinks things were better pre-Snowden when the DOJ could successfully block legal challenges to the US government's spying activities by invoking secrecy and standing claims?
(6) Haaretz this weekend ran a long article on the work I've done in the NSA case, with a lengthy interview. It was by the excellent Israeli writer Noam Sheizaf, and is one of the better and more informative articles of this sort to have been published.
(7) The Guardian's Readers' Editor Chris Elliott (the British equivalent of the ombudsman) has an interesting article assessing some of the critiques made about our NSA reporting.
(8) A coalition called "Stop Watching Us" has been formed by privacy and civil liberties groups from across the political spectrum, including the ACLU, EFF, Free Press, Freedom Works, Occupy Wall Street, Demand Progress and others. It has the support of a wide swath individuals such as internet pioneer Tim Berners-Lee, Daniel Ellsberg, Gabriella Coleman, Xeni Jardin, the actor Wil Wheaton, Reddit founder Alexis Ohanian, and Anil Dash.
On October 26, the 12th anniversary of the enactment of the Patriot Act, they will hold an anti-surveillance rally in Washington DC. Anyone able is encouraged to attend.

UPDATE

One item I neglected to include: much ado was made when President Obama announced several weeks ago that he would create an "independent" review board to monitor NSA spying for civil liberties abuses. But as Associated Press detailed this weekend, the five members he put on the board are largely Democratic loyalists if not hard-core Obama loyalists:

"Four of the five review panel members previously worked for Democratic administrations: Peter Swire, former Office of Management and Budget privacy director under President Bill Clinton; Michael Morell, Obama's former deputy CIA director; Richard Clarke, former counterterrorism coordinator under Clinton and later for President George W. Bush; and Cass Sunstein, Obama's former regulatory czar. A fifth panel member, Geoffrey Stone of the University of Chicago, leads a university committee looking to build Obama's presidential library in Chicago and was an informal adviser to Obama's 2008 presidential campaign.
"Stone wrote in a July op-ed that the NSA surveillance program that collects the phone records of every American every day is constitutional.
"'We would have liked a more diverse group,' said Michelle Richardson, an ACLU legislative counsel who attended one meeting for civil liberties groups."
Beyond that, it's controlled by Obama's top national security official. As AP put it: "with just weeks remaining before its first deadline to report back to the White House, the review panel has effectively been operating as an arm of the Office of the Director of National Intelligence, which oversees the NSA and all other U.S. spy efforts. . . . Even the panel's official name suggests it's run by Clapper's office: 'Director of National Intelligence Review Group on Intelligence and Communications Technologies.'"
